Welcome to Smart Stay Club (“the Service”). By subscribing to our membership, you agree to these Terms and Conditions (“Terms”). Please read them carefully before subscribing, as they govern your access and use of the hotel booking platform (“the Platform”), where discounted hotel rates are made available to members.

2. Membership and Subscription

2.1. Subscription Payment

• By subscribing to Smart Stay Club, you agree to pay the recurring subscription fee as stated on the website.

• The subscription fee grants you access to discounted hotel bookings available through our Platform.

• All subscription payments are billed in advance on a monthly or annual basis, depending on the plan you select at checkout.

2.2. Automatic Renewal

• Unless you cancel your subscription, it will automatically renew at the end of each billing period.

• You authorize Smart Stay Club to charge the subscription fee using your payment method on file for each renewal period unless you cancel prior to the renewal date.

2.3. Cancellation Policy

• You may cancel your membership at any time by accessing your account settings on the Platform.

• If you cancel, your subscription will remain active until the end of the current billing period, after which your membership will be terminated.

• No refunds will be provided for partial periods of service or unused access.

3. Discounted Hotel Bookings

3.1. Access to Discounts

• As a member, you have access to discounted rates on hotel bookings through the Smart Stay Club Platform. The availability and amount of discounts may vary based on location, booking dates, and hotel policies.

• Smart Stay Club does not guarantee the availability of specific hotels or discounts.

• Smart Stay Club charges a $10 booking fee per room reservation. The fee is included in the Taxes Recovery and Fees amount.

3.2. Third-Party Providers

• The hotel bookings made through Smart Stay Club are provided by third-party service providers (“Hotels”).

• Smart Stay Club is not responsible for the quality, fulfillment, or cancellation of bookings made through these third parties.

4. Refunds

• Subscription fees are non-refundable, except where required by law.

• Any refunds for hotel bookings are subject to the policies of the individual Hotels and must be requested directly through the Hotel or the booking platform.

5. Changes to Membership and Pricing

• Smart Stay Club reserves the right to modify or terminate the membership service, including the subscription pricing, at any time.

• Any changes to subscription fees will be communicated to you in advance, and you will have the option to cancel your membership if you do not agree to the new rates.

6. User Responsibilities

• You agree to provide accurate, current, and complete information when creating your membership account.

• You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

• You may not transfer or share your membership with others, except as permitted by Smart Stay Club’s membership policies.

7. Intellectual Property

• All content, including trademarks, service marks, logos, and information displayed on the Platform, is owned by Smart Stay Club or its licensors and is protected by applicable intellectual property laws.

• You may not use, reproduce, or distribute any content from the Platform without express written permission from Smart Stay Club.

• The comparison of hotel prices is based on the total final booking amount, which includes the room rate, taxes, and any applicable fees for a matching room type and booking policy.

8. Limitation of Liability

• Smart Stay Club will not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform or inability to access discounts.

• The total liability of Smart Stay Club, in connection with your use of the Platform, is limited to the amount you paid for the subscription during the last billing cycle.

9. Governing Law

• These Terms are governed by and construed in accordance with the laws of NJ.

• Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in NJ.

10. Changes to the Terms

• Smart Stay Club may update these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website or through other communication channels.

• Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
